Terms and Conditions for Transferring Money without Opening Account using 'Quick Payment via Yandex.Money' service
1. General Terms
1.1. These conditions (
Conditions) determine the procedure of executing by Limited Liability Company Non-banking Credit Organization “Yandex.Money” (
NBCO) money transfers ordered by individuals (
Clients) without opening a bank account provided under
Quick Payment via Yandex.Money Service.
Quick Payment via Yandex.Money Service allows you to make payments in Russian rubles using non-personalized e-money wallet (
Quick Payment via Yandex.Money allows you to make the Payments to corporations (
Merchants) and individuals (
Recipients). The NBCO may limit the list of the Recipients and the Merchants at their own discretion inter alia by a type of funding source.
1.4. If you add money to your e-wallet in accordance to Section 2.1.1. (a) of the Conditions (excluding mobile applications) you may use preapproved payments (
Preapproved Payments). The Preapproved Payments allow you to authorize the Merchant to charge your e-wallet directly on a regular or sporadic basis. The NBCO may limit the list of the Merchants and the Recipients for the Preapproved Payments.
1.5. If the NBCO requested the Client’s mobile phone number in the course of transferring e-money or adding money to an account, it can be used for the Client’s authentication for future Payments.
2. Types of Funding Sources
2.1. You may add money to your e-wallet: 2.1.1. With a bank card (
Card): 2.1.1.(a) on the site http://www.yandex.ru or on the site https://money.yandex.ru (
Service Page) 2.1.1.(b) at Sberbank ATMs. 2.1.2. Via an agent (sub-agent) or a money transfer provider. 2.1.3. Via a mobile operator if this operator and the NBCO (the NBCO’s partner) have entered into a contract on funding e-wallets. 2.1.4. From your bank account via online banking of the NBCO’s partner bank. 2.1.5. Through payout partner.
2.2. The NBCO may limit the list of the types of funding source at any time and for any reason.
2.3. The Cards as a funding source under Section 2.1.1. (a) of the Conditions: — the Cards belong to the international payment systems VISA or MasterCard with authentication code (CVV2 or CVC2consequently) supporting 3-D Secure authentication protocol (Verified by Visa and MasterCard SecureCode consequently). The authentication code may be omitted for the MasterCard Maestro Cards issued by OJSC Sberbank of Russia — the Card issuer successfully authenticates you via 3-D Secure authentication protocol. Only first transaction of the Preapproved Payment to a particular recipient undergoes such authentication — the Card issuer did not forbid the transaction by any other reason.
2.4. The Cards as a funding source under Section 2.1.1. (b) of the Conditions: — the Card issuer successfully authenticates you — the Card issuer did not forbid the transaction by any other reason.
3. Making Payments
3.1. Ordering the Payment: 3.1.1. When adding money to your e-wallet with the Card in accordance to Section 2.1.1. (a) of the Conditions, undertake the following actions: — on the Service Page—enter the recipient details, payment sum, and the Client‘s identifier in the Merchant’s (the Recipient’s) invoice, and confirm the Preapproved Payments (if applicable) — on the Service page or in a mobile app—enter the Card number, cardholder’s name, expiration date, authentication code (CVV2/CVC2), and verification code from the text message sent to your phone number (this code is only required if the Client is being authenticated under Section 1.5. of the Conditions). 3.1.2. When adding money to your e-wallet with the Card in accordance to Section 2.1.1. (a) of the Conditions, undertake the following actions: — authorize the Card in Sberbank ATM by entering the Card’s PIN code — at the ATM menu—enter the recipient details, payment sum, and the Client‘s identifier in the Merchant’s (the Recipient’s) invoice, and confirm the Preapproved Payments (if applicable). 3.1.3. When adding money to your e-wallet via an agent (sub-agent) or a money transfer provider, undertake the following actions: — on the Service Page—enter the recipient details, payment sum, the Client‘s identifier in the Merchant’s (the Recipient’s) invoice, and the Client’s mobile phone number (for refunding the Payment order if it cannot be executed by the NBCO), and then confirm the Preapproved Payments (if applicable) — confirm the order by the method specified by the agent (sub-agent) or the money transfer operator. 3.1.4. When adding money to your e-wallet via a mobile operator, undertake the following actions: — provide a mobile operator with the recipient details, payment sum, and the Client‘s identifier in the Merchant’s (the Recipient’s) invoice — confirm these details by the method specified by the mobile operator 3.1.5. When adding money to your e-wallet via online banking of the NBCO’s partner bank, undertake the following actions: — provide a bank with the recipient details, payment sum, and the Client‘s identifier in the Merchant’s (the Recipient’s) invoice — confirm these details by the method specified by the bank — to pay for iTunes PINs, which may additionally require the client to send text message on number #900 (for relevant Russian phone numbers linked to Sberbank’s Mobile Bank service) in the format
iTunes <amount> where <amount> is the sum of money in Russian rubles. 3.1.6. When adding money to your e-wallet through a payout partner undertake the following actions: — on the payout partner’s site—the recipient details, payment sum, and the Client‘s identifier in the Merchant’s (the Recipient’s) invoice and other information requested by the payout partner.
3.2. On ordering the money transfer that can only be executed by an identified person by Russian law, the Client should provide accurate details required for executing KYC/simplified KYC procedure by the NBCO.
3.3. Your payment order will not be executed if: — your Payment order is not complied to requirements of Section 3.1. of the Conditions — you do not have enough money for executing the payment or paying the NBCO fee — your payment exceeds the NBCO’s limits — the Card issuer is a credit organization incorporated and registered according to the foreign law. The NBCO may deny executing of your Payment order in its sole discretion if you added money to your e-wallet by the Card.
3.4. The Payment is completed when the Recipient’s (the Merchant’s) bank gets money to its account (except as otherwise provided in the contract).
3.5.Any unclaimed, refunded or denied payment will be returned to you by one of the following methods inter alia: 3.5.1. to the issuing bank for refunding to the Card having been used as a funding source 3.5.2. to the mobile operator for refunding to the phone number balance having been used as a funding source 3.5.3. to the bank account having been used as a funding source 3.5.4. to the bank account of a payout partner that has been used as a funding source 3.5.5. to the e-wallet in the NBCO’s system having been used for funding through the agent (sub-agent), for which sufficient information for KYC/simplified KYC was provided to the NBCO and for which “phone link” was activated in accordance with General Terms and Conditions of Yandex.Money Service.
3.6. The agreement between the Recipient and the NBCO may set forth limitation of money refunds depending on particular funding sources.
3.7. The NBCO in its sole discretion may determine the way of refunding. Inter alia, it depends on funding source and can differs from the ones listed in sub-clause 3.5. of the Conditions.
3.8. The NBCO refunds you the Payment within 30 days from the date of receiving the Payment from the Recipient’s (the Merchant’s) bank by the NBCO or from the date of revealing that the Payment cannot be executed. 3.8.1. The refund is deemed completed when the bank servicing the partners listed in sub-clauses 3.5.1. - 3.5.4. receives the NBCO’s money transfer, except as otherwise provided in the agreement the partners entered into with the NBCO. 3.8.2. The term of refunding is set forth by an agreement entered into between the bank and the partners listed in sub-clauses 3.5.1. - 3.5.4 of this Terms and Conditions.
3.9. If the sum of the Payment is less than the sum of money funded by the Client and less than 500 (five hundred) rubles, the NBCO adds the remaining funds to the Client’s mobile phone balance. If the difference between the money funded and the Payment amount is more than 500 (five hundred) rubles, the NBCO adds this amount to the Client by one of the methods listed in sub-clause 3.5. of the Conditions.
4. The NBCO Fees
4.1. The NBCO has the right to charge the Client with remuneration for using the service, as specified on the Service page https://money.yandex.ru — NBCO Fees.
5. Accepting the Agreement
5.1. Under Article 437 of the Civil Code of the Russian Federation these Conditions authorize you to make the NBCO offers for using
Quick Payment via Yandex.Money Service.
5.2. If you send the Payment order in accordance with the Section 3.1., this shall also mean that you send the offer to use the “Quick Payment via Yandex.Money” Service” under the Conditions. The Client assigns the NBCO to perform the following actions: — to start an e-wallet for the Client — to fund e-wallet and simultaneous charging e-wallet according to the Client’s Payment order — to execute the Preapproved Payments until the Client cancels his or her order for the Preapproved Payments. You may stop the Preapproved Payment at any time up to 2 Business Days prior to the date the next payment is scheduled to be made by notifying the NBCO. To stop the Preapproved Payments, follow this link https://money.yandex.ru/feedback/, specify the Merchant’s name (the Recipient of the Preapproved Payments), first six and last four figures of the Card number, and the sum of the last Preapproved Payment. In two days the NBCO stops the Preapproved Payments, all the future payments under your agreement with the Merchant will be canceled.
5.3. The NBCO accepts the Client’s offer by sending the acceptance to the Client by one of the following methods (depending on the method of making the Payment order): — on the Service Page, in the mobile app — via a cash-in kiosk or other self-service device used by the Client — through an agent (sub-agent) — via a mobile operator — via a credit organization — via a payout partner — by sending to the Client a text message with a PIN code in the cases specified in paragraph 3 of sub-clause 3.1.5. of the Conditions; — on the Hold-for-Pickup page. The NBCO in its sole discretion can deny the Client’s offer inter alia in cases mentioned in Section 3.3. of the Conditions.
6.1. The NBCO shall not be liable to the Client for any loss or damage that may be incurred by the Client because of: — technical failures (shutdown/damage of electronic power supply and communication networks, failures of processing center software and technical failures in payment systems) — the Client fails to provide the NBCO with accurate Payment information — declining of the Client’s offer by the NBCO or declining to execute the Client’s offer by the NBCO; — the Recipient‘s fraudulent activities — illegal activity of the third parties — any fraudulent usage of the Service by the Client or the third parties — the Client fails to provide the NBCO with accurate information for the Preapproved Payments. The Client is aware and agrees that any claims concerning execution of the Preapproved Payment are subject for disputing between the Client and the Recipient (the Merchant).
6.2. You give your free and absolute consent for processing your personal information by the NBCO in the NBCO’s system and for delivering your personal data to any third persons for the purposes of providing “Quick Payment via Yandex.Money” Service.
6.3. At its own discretion, the NBCO is entitled to send commercials, including via text messages, to the Client's email address and(or) phone number specified by the Client when making a transfer via the Quick Payment via Yandex.Money service. The Client is entitled to cancel such messages by sending a corresponding message to the NBCO.
6.4. NBCO shall inform the Client about transactions carried out via electronic payment methods by sending the Client a corresponding notification to the email address provided by the Client when submitting the transfer order. If the Client did not provide an email address, the NBCO is considered to have fulfilled the obligation to inform the Client about the transaction once it sends the message notifying the Client that the transfer order has been accepted in accordance with the procedure specified in c. 5.3 of these Conditions. The notifications specified in paragraphs one and two of this c. 6.4 shall be deemed received by the Client within three hours after being sent. NBCO shall not be responsible for the Client’s inability to access the means to receive a notification, or late receipt of a notification, as well as communication network failures caused by reasons beyond the power of the NBCO resulting in late receipt or non-receipt of the NBCO's notifications by the Client.
6.5. NBCO provides the Client with the opportunity to send notifications about the inability to access an electronic means of payment or the use of an electronic means of payment without the Client's consent using methods indicated at the NBCO's website.
6.6. You agree that any claim or dispute you may have against the NBCO must be resolved by a court located in Moscow, Russia. These Conditions shall be governed in all respects by the laws of the Russian Federation regardless to any conflicts of law provisions.
6.7. Under paragraph one of the Article 450 of the Civil Code of the Russian Federation the NBCO may amend the Conditions at any time by posting a revised version on the Service Page. The revised version will be effective at the time the NBCO posts it.
